MagicSubtitle – Terms of Service

Welcome to MagicSubtitle (“we”, “our”, or “the Service”). By accessing or using MagicSubtitle, you (“User”, “you”) agree to the following Terms of Service. If you do not agree, you must discontinue use of the Service immediately.

These Terms govern your use of:

• The MagicSubtitle website
• AI subtitle generation, transcription, translation, and summary tools
• Any associated software, APIs, or applications

Please read them carefully.

1. Eligibility

You may use the Service only if:

• You are at least 18 years old, or the legal age of majority in your jurisdiction
• You can enter legally binding agreements
• You comply with these Terms and all applicable laws

MagicSubtitle is not intended for children under 13 (COPPA) or under 16 in the European Union (GDPR).

2. Description of Service

MagicSubtitle provides tools for:

• Subtitle generation
• Video/audio transcription
• Translation across multiple languages
• Automated video text summaries

We may update, change, or modify features at any time to improve service quality, performance, or security.

3. User Responsibilities

By using the Service, you agree that:

• You will only upload content that you have the legal right to use.
• You will not upload:
  • Illegal content
  • Copyrighted material without appropriate permission
  • Sensitive personal data (including medical, biometric, financial, or similar information)
• You will not attempt to:
  • Reverse engineer, decompile, or tamper with the platform
  • Abuse, overload, or disrupt system resources
  • Use the Service for harmful, fraudulent, or malicious activities

You are responsible for maintaining the confidentiality and security of your account credentials and for all activities that occur under your account.

4. Content Ownership

You retain full ownership of the content you upload to MagicSubtitle.

MagicSubtitle does NOT:

• Claim ownership of your files
• Use your data to train AI models
• Sell or share your data with third parties for marketing purposes

By uploading content, you grant MagicSubtitle a limited, non-exclusive, revocable, and temporary license to process that content solely for the purpose of providing the Service to you (e.g., generating subtitles, transcriptions, translations, or summaries).

This license ends automatically when the relevant files are deleted or expire from the system.

5. AI Processing & External APIs

MagicSubtitle may process your content using, among others:

• OpenAI APIs
• Whisper / Faster-Whisper speech-to-text models
• Locally hosted AI models running on our infrastructure

You acknowledge that AI-generated outputs may contain:

• Errors or omissions
• Inaccuracies or misinterpretations
• Limitations inherent to machine learning systems and probabilistic models

MagicSubtitle is not liable for any decisions, actions, or consequences arising from your use of AI-generated content or reliance on such outputs.

6. File Storage & Deletion

• Uploaded files are stored temporarily for processing purposes only.
• Processed results (e.g., subtitles, transcripts, translations) may remain available for your convenience.
• You may delete outputs and associated content at any time, where such functionality is provided.
• Files may be automatically deleted or removed to manage storage and maintain system performance.

MagicSubtitle is not designed or intended to be a permanent or long-term file storage service.

7. Acceptable Use Policy (AUP)

You agree NOT to use MagicSubtitle for:

• Hate speech, harassment, threats, or incitement to violence
• Child sexual abuse material (CSAM) or any sexualized content involving minors
• Deepfakes that impersonate real individuals without their explicit consent
• Political manipulation, disinformation, or large-scale influence operations
• Circumventing copyright laws or enabling third parties to do so
• Automated scraping, bulk extraction, denial-of-service attacks, or similar abuse

Violation of this Acceptable Use Policy may result in account suspension, restriction, or permanent ban, at our sole discretion.

8. Payments & Subscriptions

Some features of MagicSubtitle require a paid subscription, usage-based credits, or other fees.

By making a purchase, you agree that:

• All payments are processed by third-party providers such as Stripe or PayPal.
• Applicable taxes or fees may be added depending on your region or local law.
• Subscription fees (if any) are billed on a recurring basis unless you cancel your subscription before the next billing cycle.
• Refunds, if applicable, are handled according to our Refund Policy.

If a payment cannot be processed (for example, due to an expired card or failed transaction), we may suspend or restrict access to premium or paid features until payment is successfully completed.

9. Service Availability

We strive to provide a reliable and performant service, but we do not guarantee:

• Uninterrupted or continuous service
• Operation without errors, bugs, or defects
• Zero data loss or perfect data integrity

We may modify, suspend, or discontinue some or all features of the Service at any time, with or without prior notice, for maintenance, upgrades, or other reasons.

MagicSubtitle is not liable for downtime, maintenance windows, network issues, or other events that may temporarily affect access to the Service.

10. Limitation of Liability

To the fullest extent permitted by applicable law:

• MagicSubtitle is not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses.
• MagicSubtitle’s total aggregate liability arising out of or relating to the Service will not exceed the amount you paid for the Service in the twelve (12) months preceding the event giving rise to the claim.
• MagicSubtitle is not responsible for losses caused by:
  • AI inaccuracies or misinterpretations
  • User misuse or violation of these Terms
  • Third-party service interruptions or failures
  • Unauthorized account access resulting from weak or compromised passwords

Some jurisdictions do not allow certain limitations of liability. In such cases, the limitations described above apply only to the extent permitted by law.

11. Disclaimer of Warranties

MagicSubtitle is provided on an “AS IS” and “AS AVAILABLE” basis, without any warranties of any kind.

We expressly disclaim all warranties, whether express, implied, or statutory, including but not limited to:

• Implied warranties of merchantability
• Fitness for a particular purpose
• Non-infringement of third-party rights

We do not guarantee:

• The accuracy or completeness of translations, transcriptions, or summaries
• The permanent availability or retention of stored files
• The suitability of AI-generated outputs for any specific context or use case

12. Governing Law

These Terms are governed by:

• The laws of your country or region of residence, and/or
• Applicable international standards for online and digital services

Any disputes arising out of or relating to these Terms or the use of the Service should first be addressed through good-faith negotiation between you and MagicSubtitle.

If the parties cannot resolve the dispute amicably, the matter may be submitted to arbitration or brought before a competent court, depending on applicable jurisdiction and legal requirements.

13. Changes to Terms

MagicSubtitle may update or modify these Terms of Service from time to time.

When changes are made:

• The “Last Updated” date at the top of this page will be revised.
• Continued use of the Service after such changes constitutes your acceptance of the updated Terms.

If you do not agree with the revised Terms, you must stop using the Service and, if applicable, cancel any active subscriptions.
